Terms of Service

1. Acceptance of Terms
By accessing or using Jess ("Service"), operated by Chatelier LTD (Company № 16846652, registered in England & Wales), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Jess is an AI-powered travel agent that provides:
- Search and aggregation of real-time travel data (flights via Duffel API, hotels via Channex PMS)
- AI-powered hotel scoring and recommendations (Decision Engine)
- Voice and text-based query input
- Booking and payment processing (USDC on Base blockchain)
- Hotel escrow protection (Safe Stay)
- Transfer and activity booking
We do not guarantee accuracy or availability of third-party data. Flight prices, hotel availability, and travel information are provided by external partners and may change without notice.
3. Eligibility
You must be at least 18 years old to use the Service. If you are under 18, you may use the Service only with legal guardian consent and supervision.
4. User Accounts
When creating an account, you agree to:
- Provide accurate and complete information
- Keep your credentials (including wallet PIN) secure and confidential
- Be responsible for all activity under your account
- Notify us immediately of unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Payments & Billing
The Service processes payments using USDC stablecoin on the Base blockchain. By making a payment, you acknowledge:
- Payments are processed on-chain and may be irreversible once confirmed
- Exchange rate fluctuations between USDC and local currencies are your responsibility
- Gasless transactions are facilitated via EIP-2612 permit signatures — no gas fees are charged to users
- Refund policies vary by booking type (flights, hotels, transfers) and are subject to provider terms
Safe Stay Escrow: When using Safe Stay, your hotel deposit is held in smart contract escrow and released to the hotel upon check-in. Cancellation and dispute policies are outlined at the time of booking.
6. Use Restrictions
You agree NOT to:
- Use the Service for illegal purposes
- Scrape, reverse-engineer, or decompile the platform
- Interfere with system integrity or security
- Use automated bots or scripts without written permission
- Attempt to manipulate hotel scoring or review systems
- Create multiple accounts to circumvent restrictions
7. Third-Party Services
The Service integrates with third-party providers including Duffel (flights), Channex (hotel PMS), and blockchain networks. We are not responsible for:
- Pricing accuracy of third-party data
- Availability changes made by airlines or hotels
- Transactions or disputes with third-party providers
- Service interruptions caused by external systems
8. AI & Decision Engine Disclaimer
Jess uses artificial intelligence (powered by OpenAI) and our proprietary Decision Engine to provide recommendations. You acknowledge that:
- AI recommendations may be inaccurate, incomplete, or outdated
- Hotel scores are based on automated analysis of reviews and should not be the sole basis for booking decisions
- The Decision Engine's scoring methodology is proprietary and not disclosed
- AI-generated responses do not constitute professional travel advice
9. Passport & Personal Data
When you provide passport information for flight bookings:
- Data is encrypted using AES-256-GCM before storage
- Passport data is only used for booking purposes and shared with airlines as required
- You consent to this processing under our Privacy Policy
10. Intellectual Property
All content, branding, software, and the Decision Engine are owned by Chatelier LTD or licensed to us. You may not copy, distribute, modify, or create derivative works without written permission.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid to us in the 12 months preceding the claim
- We are not liable for losses caused by third-party service failures, blockchain network issues, or AI recommendation errors
12. Termination
We may suspend or terminate your access at any time without notice if Terms are violated. Upon termination, your right to use the Service ceases immediately. Provisions relating to intellectual property, limitation of liability, and governing law survive termination.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
